These Terms of Use (“Terms”) govern your access to and use of www.jakegoodmanmd.com and its content and features (collectively, the “Website”). The Website is operated by Goodman Psychiatry, PC and Goodman Psychiatry, PLLC, each doing business as Goodman Psychiatry (collectively, “Goodman Psychiatry,” “we,” “us,” or “our”). By accessing or using the Website, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Website.
1. Informational Purposes Only
The Website provides general educational and informational content. It is not medical advice, psychiatric advice, diagnosis, treatment, psychotherapy, crisis intervention, or a substitute for evaluation by a qualified health professional who understands your individual circumstances. Do not disregard, delay, or change professional medical advice because of Website content.
Medical and mental-health information changes over time. Although we may update Website content, we do not warrant that it is complete, current, or applicable to you.
2. No Physician-Patient Relationship
Accessing the Website, reading its content, subscribing to communications, sending an email, or submitting a contact or consultation-request form does not create a physician-patient relationship or any other clinical relationship with Goodman Psychiatry or Jake Goodman, MD.
A physician-patient relationship is established only after the Practice has accepted you as a patient, completed any required intake and consent process, confirmed that care may lawfully be provided where you are physically located, and otherwise agreed to provide clinical services. The Practice may decline a request for services and does not guarantee availability, acceptance, or a particular treatment.
3. Emergencies and Urgent Concerns
Do not use this Website for emergencies.
If you are experiencing a medical or psychiatric emergency, believe you may harm yourself or someone else, or need immediate assistance, call 911 or go to the nearest emergency department. In the United States, you may also call or text 988 to reach the Suicide & Crisis Lifeline. Website forms, email, newsletters, and social-media channels are not monitored continuously and are not appropriate for urgent or time-sensitive matters.
4. Licensure and Geographic Limitations
Information about services does not mean that clinical care is available in every jurisdiction. The ability to provide care depends on applicable laws, professional licensure, the patient's physical location at the time of service, clinical appropriateness, and Practice policies. Nothing on the Website is an offer to practice medicine or provide health care where doing so would be unlawful.
5. Website Forms and Communications
If you submit information through a Website form or email, you agree to provide information that is accurate and that you are authorized to provide. Do not use general Website channels to send urgent messages, detailed medical histories, medication requests, or other sensitive health information. Electronic communications can be delayed, misdirected, intercepted, or accessed by unauthorized persons.
We may respond using the contact information you provide. A response to an inquiry does not, by itself, create a physician-patient relationship or guarantee an appointment.
6. Privacy
Our Privacy Policy describes Website data practices and is incorporated into these Terms. Clinical information maintained in connection with care may also be governed by a separate Notice of Privacy Practices. Third-party forms, embedded media, and linked services are governed by their own terms and privacy practices.
7. Intellectual Property
The Website and its original text, graphics, logos, photographs, videos, design, arrangement, and other content are owned by or licensed to Goodman Psychiatry and are protected by copyright, trademark, and other laws. Goodman Psychiatry and associated names, logos, and marks may not be used in a manner likely to cause confusion or imply endorsement without prior written permission.
We grant you a limited, revocable, nonexclusive, nontransferable license to access and use the Website for personal, noncommercial, lawful purposes. Except as permitted by law, you may not copy, reproduce, republish, distribute, sell, modify, create derivative works from, scrape, frame, reverse engineer, or commercially exploit Website content without prior written permission.
8. Acceptable Use
You may not use the Website to:
Violate any law, regulation, or the rights of another person.
Transmit malicious code, interfere with security, disrupt operation, probe vulnerabilities, or attempt unauthorized access.
Impersonate another person, submit false information, or misrepresent an affiliation.

Send unlawful, threatening, harassing, defamatory, obscene, or infringing material.

12. Limitation of Liability
To the fullest extent permitted by law, Goodman Psychiatry and its owners, clinicians, employees, contractors, agents, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, revenue, profits, goodwill, or use, arising from or related to the Website or reliance on Website content.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited. These Terms do not alter rights or obligations arising from an established clinical relationship or applicable professional standards of care.
13. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Goodman Psychiatry and its owners, clinicians, employees, contractors, and agents from third-party claims, losses, liabilities, and reasonable expenses arising from your unlawful misuse of the Website, violation of these Terms, or infringement of another person's rights.
14. Changes, Suspension, and Termination
We may modify, suspend, restrict, or discontinue any part of the Website at any time. We may update these Terms by posting a revised version and changing the effective date. Your continued use of the Website after the revised Terms become effective constitutes acceptance of the revised Terms.
15. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. To the extent a dispute concerning the Website is properly brought in court, and subject to applicable law, it will be brought in the state or federal courts located in San Diego County, California, and you consent to their jurisdiction and venue.
16. Severability; Waiver; Entire Agreement
If any provision of these Terms is held unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver. These Terms and the Privacy Policy constitute the entire agreement concerning use of the Website and supersede prior understandings about that subject.
